By accessing or using https://sakuragency.com (the “Site”), you agree to these Terms of Service (“Terms”). If you don't agree, please don't use the Site. We may update these Terms from time to time as described in Changes to These Terms below.
These Terms govern your use of the Site itself — browsing it, reading it, and submitting the project brief form. They are not a services agreement. If you engage Sakura Agency for a project, the scope, deliverables, timeline, price, payment terms, and any project-specific intellectual-property or confidentiality terms are set out in a separate signed proposal or agreement for that project, and that agreement controls wherever it conflicts with these Terms.
Sakura Agency is a full-cycle digital product agency providing product design, full-stack development, SEO, digital marketing, branding and motion design, and AI process automation. Descriptions of these services on the Site — including case studies, pricing explanations, and process descriptions — are informational and don't themselves constitute an offer or a binding commitment to deliver a specific outcome; a project only becomes binding once both parties sign a proposal or agreement for it.
You must be able to form a legally binding contract to submit the project brief form on behalf of yourself or a business — in most jurisdictions, that means being at least 18 years old. The Site is directed at businesses and professionals evaluating our services, not at children.
Everything on the Site — copy, case studies, visuals, the Sakura Agency name and mark, layout, and code — is the property of Sakura Agency or its licensors and is protected by copyright and other intellectual property laws. You may view and share pages of the Site for your own evaluation of our services, but you may not reproduce, republish, or create derivative works from Site content for any other purpose without our written permission.
Case studies on the Site describe real project outcomes and results; where a case study uses placeholder or illustrative figures pending a client's approval to publish real data, we label it as such.
When you submit the project brief form — including any file you attach — you confirm that you have the right to share that information and that it doesn't infringe anyone else's rights. You grant Sakura Agency permission to use what you submit for the purpose you submitted it for: evaluating your project and responding to your inquiry. We don't claim ownership over your project idea, materials, or attached files, and we won't use them for any purpose beyond responding to you and, if you engage us, delivering that project. We may suspend or restrict access for anyone who violates this section, and we filter and may silently discard submissions our automated systems flag as spam.
The Site links to third-party destinations — Telegram, WhatsApp, LinkedIn, and Twitter/X among them — that we don't operate or control. We're not responsible for the content, terms, or privacy practices of any site or service we link to; visiting them is at your own risk and subject to their own terms.
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure, or error-free. Nothing on the Site — including case-study results, process timelines, or pricing explanations — is a guarantee of the outcome, cost, or timeline of any future project; those are agreed individually in a project's signed proposal.
To the fullest extent permitted by applicable law, Sakura Agency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of — or inability to use — the Site, even if we've been advised of the possibility of such damages. Where liability can't be excluded under applicable law, our total liability arising from your use of the Site is limited to the greatest extent that law allows. This section applies to the Site only; liability terms for an active project are set out in that project's signed agreement.
You agree to indemnify and hold Sakura Agency harmless from any claim, damage, or expense (including reasonable legal fees) arising from your violation of these Terms or from content you submit through the Site that infringes a third party's rights.

Until then, please raise any dispute directly with us at the contact below and we'll work through it in good faith.]
We may update these Terms as the Site or our services change. If we make a material change, we'll update the “Last updated” date at the top of this page. Continuing to use the Site after a change means you accept the updated Terms.
If any provision of these Terms is found unenforceable, the rest remain in full effect and the unenforceable provision will be interpreted to best reflect its original intent. These Terms, together with our Privacy Policy, are the entire agreement between you and Sakura Agency regarding use of the Site, and supersede any prior agreement about it — separate from, and without affecting, any signed project agreement you may have with us.
